Call for Dr. Kizza Besigye’s Immediate Release Gains Momentum

Dr. Kizza Besigye’s legal team demanded his immediate release, arguing that his ongoing detention violates constitutional guarantees of personal liberty. During today’s court proceedings, lead counsel Erias Lukwago urged the judge to release him, stating there are no new charges against him.

“There is no justification for keeping him imprisoned,” Lukwago emphasized. “We ask the court to order his release immediately. Any further detention would violate his fundamental rights.”

Lukwago explained that the General Court Martial’s charges cannot transfer to the Director of Public Prosecutions (DPP). As a result, Besigye has not faced formal charges in a civilian court, which undermines the legality of his arrest and detention.

Another attorney, Kalibbala Ernest, drew parallels between this case and the Ibingira ruling. He argued that although authorities knew Besigye’s location, they failed to justify extending his detention. “The Supreme Court did not authorize prolonged imprisonment unless the individual was convicted,” Kalibbala stated, challenging the basis for Besigye’s continued imprisonment.

The defense team insisted that political motives drove Besigye’s arrest and prolonged detention, lacking legal grounds. They also raised concerns about his deteriorating health, warning that further confinement without medical care could endanger his life.

Earlier in the day, Judge Singizi Douglas ordered Besigye returned to prison due to his worsening condition. The judge acknowledged fears that he might collapse during the hearing, prompting a brief adjournment.

As the trial resumes, the court will decide whether to release Besigye or continue his detention. Outside the courtroom, supporters protest across the country, demanding his freedom and emphasizing the need for justice.

This high-profile case highlights broader issues surrounding political freedoms and judicial independence in Uganda, drawing national and international attention. With the stakes high, all eyes remain on the court’s decision.
