Ghana’s President Suspends Chief Justice

In a historic and controversial move, President John Mahama has suspended Chief Justice Torkornoo, triggering widespread reactions across Ghana’s political and legal arenas. This marks the first time a sitting Chief Justice has faced suspension in Ghana’s democratic history. As a result, many experts and citizens see it as politically charged.

Gertrude Torkornoo, Ghana’s third female Chief Justice, took office in 2023 after her nomination by former President Nana Akufo-Addo. She leads the judiciary and oversees the administration of justice nationwide. However, her suspension follows three petitions that call for her removal. Authorities have not yet disclosed the content of these petitions.

According to Ghana’s laws, a Chief Justice can only be removed for incompetence or misbehaviour. Therefore, these claims demand a fair and transparent process. Justice Torkornoo has not responded publicly to the allegations so far.

Meanwhile, former Attorney General Godfred Yeboah Dame has strongly criticized the move. In a BBC interview, he stated, “I think it is a complete charade… the greatest assault on the independence of the judiciary under the constitutional dispensation of this country.”

The Chief Justice Torkornoo suspension raises major concerns about judicial independence. Consequently, many legal analysts warn that this action could set a dangerous precedent. It may allow the executive branch to interfere in judicial matters, which goes against the principle of separation of powers.

Furthermore, critics argue the suspension could serve as a political tactic to intimidate the judiciary. If that proves true, it may seriously damage public trust in both the legal system and democratic governance.

Earlier this year, Torkornoo survived another attempt to remove her. Former President Akufo-Addo rejected that petition, citing major flaws. Now, with a new administration in power, these efforts have resurfaced. This shift suggests that deeper political motives may be influencing the current decision.

As the investigation continues, both local and international observers are watching closely. In addition, legal bodies and civil society organizations are calling for a fair process and full respect for constitutional procedures.

Chief Justice Torkornoo’s suspension marks a turning point in Ghana’s democratic journey. It tests the nation’s commitment to justice, law, and independent institutions. Whether this action was necessary or politically motivated remains unclear. Nevertheless, one thing is certain—Ghana’s judiciary now stands at a critical crossroads.
