Mistrial Declared in Harvey Weinstein Rape Case

Harvey Weinstein mistrial was declared Thursday in a New York courtroom. One juror refused to continue deliberations on the 2013 rape charge involving actress Jessica Mann.

The jury had already delivered two verdicts—guilty on one charge and not guilty on another. However, they could not agree on the final rape charge, which led to the judge’s decision. Deliberations lasted six days and included intense conflicts among jurors.

Juror Conflict Ends Deliberations

The foreperson raised concerns early in the week. He reported jurors shouting, pressuring him, and even making threats. One person allegedly said, “I’ll meet you outside one day,” prompting fear and refusal to continue.

On Thursday morning, the foreperson told the court he could not return to the jury room. Judge Curtis Farber declared the Harvey Weinstein mistrial, acknowledging the severity of the juror tension.
“Sometimes jury deliberations become heated. I understand this particular deliberation was more heated than some others,” he noted.

Prosecutors Ready for Retrial

Manhattan District Attorney Alvin Bragg responded swiftly. He confirmed that prosecutors would retry Weinstein on the unresolved rape charge.
“We are ready to go forward to trial again,” he said, after speaking with Jessica Mann.

Mann reaffirmed her commitment in a public statement:
“I am ready, willing and able to endure this as many times as it takes for justice and accountability to be served.”

Weinstein Convicted on Assault

The jury found Weinstein guilty of sexually assaulting Miriam Haley. However, they acquitted him of assaulting Polish model Kaja Sokola.

This Harvey Weinstein mistrial followed the overturning of his 2020 conviction. The appeals court ruled that the judge in the original trial allowed improper testimony, leading to a flawed process.

More Legal Hurdles Ahead

Weinstein, 73, suffers from cancer and diabetes. He stayed at Bellevue Hospital during the trial and used a wheelchair in court.

Despite the mistrial, Weinstein remains convicted in Los Angeles. There, he faces a 16-year sentence for separate sex crimes.

His spokesperson, Juda Engelmayer, expressed disappointment but remained defiant:
“Harvey is disappointed in the single verdict but hasn’t lost faith or the heart to continue fighting to clear his name.”

Hollywood Legacy Destroyed

Once a powerful figure in Hollywood, Weinstein co-founded Miramax Films with his brother Bob. The studio produced hits like Shakespeare in Love and Pulp Fiction.

Over 100 women have accused Weinstein of misconduct, assault, or rape. While not all led to charges, his criminal convictions have ensured lasting consequences.
