UN War Crimes Judges Rule Rwandan Genocide Suspect Felicien Kabuga Unfit for Trial, Propose Alternative Legal Process

In a decision announced on Wednesday, United Nations war crimes judges have declared that Felicien Kabuga, a suspect in the Rwandan genocide, is unfit to stand trial. However, the judges have proposed a stripped-down legal process to address the crimes he is accused of committing.

Felicien Kabuga, a former tycoon, is accused of establishing a hate broadcaster that played a significant role in fueling the 1994 genocide in which over 800,000 people were killed. Kabuga had gone on trial in The Hague in September of the previous year, but the judges now state that medical experts have diagnosed him with “severe dementia,” rendering him incapable of participating fully in court proceedings.

The International Residual Mechanism for Criminal Tribunals issued an order stating that Kabuga is not fit for trial and is unlikely to regain fitness in the future. However, the judges emphasized the importance of addressing the genocide crimes against Kabuga in a court setting for the sake of the victims, survivors, and the international community.

The proposed alternative finding procedure aims to resemble a trial as closely as possible, although it would not lead to a conviction. While one judge dissented from this approach, the majority agreed that it was crucial to address the charges against Kabuga in court.

Prosecutors allege that Kabuga, once among Rwanda’s wealthiest individuals, established hate media that incited ethnic Hutus to commit violence against Tutsis and supplied machetes to death squads. During the initial stages of his trial, Kabuga refused to appear in court or attend remotely, later following proceedings via video-link from a wheelchair at the detention center.

In March, the trial was temporarily halted due to health concerns, despite earlier attempts by Kabuga’s defense lawyers to declare him unfit for trial. In their recent order, the judges noted that three court-appointed medical experts had found a significant deterioration in Kabuga’s mental abilities since the commencement of the trial. As a result, he was unable to comprehend the court proceedings, understand evidence, provide instructions to his lawyers, or testify.

While scrapping the trial entirely was deemed inappropriate, the court emphasized the importance of addressing the charges against Kabuga for the benefit of the victims, survivors, and the international community. The proposed alternative legal process, inspired by similar approaches used in some Commonwealth countries, would respect Kabuga’s legal rights. Importantly, Kabuga would not be required to attend this new legal process.

Felicien Kabuga was apprehended in Paris in 2020 after evading capture for several decades and subsequently sent to The Hague for trial. He has pleaded not guilty to charges of involvement in an infamous Hutu radical radio station that called for the extermination of Tutsis during the 1994 genocide. Additionally, he is accused of supplying machetes and providing support to the Interahamwe Hutu militia, which carried out numerous killings.

Kabuga represents one of the last remaining Rwandan genocide suspects to face justice, with 62 individuals already convicted by the tribunal. The proposed alternative legal process seeks to ensure that the crimes against humanity and genocide charges against him are addressed in a manner that upholds justice and serves the interests of the victims, survivors, and the international community at large.
