The Buganda Road Chief Magistrate’s Court has experienced another setback in the incitement case against Dr. Kizza Besigye, a seasoned political figure, due to the prosecution’s nonappearance.
Magistrate Grade 1, Winnie Nakya, noted that although the prosecution was present on the court premises, they were preoccupied with another case of significant public interest, preventing them from attending to Besigye’s hearing. “The DPP redirected the prosecutor to a different case, so we ask for your patience as we reschedule your hearing to a later date,” stated Magistrate Nakya.
Consequently, the hearing has been deferred to April 19.
Dr. Besigye perceives the postponement as intentional, criticizing the court for undermining their cause and squandering their time and resources on what he considers a minor issue. “We view this as persecution under the guise of prosecution, yet such challenges only strengthen our resolve,” Dr. Besigye remarked.
Dr. Besigye and Lubega Mukaaku, a Democratic Party stalwart, are contending with charges of inciting violence.
The charges against Besigye stem from an incident on May 24, 2022, at Arua Park, Muno village, Shauriyako parish, in the Central Division of Kampala district. He allegedly made public statements at an assembly without a lawful excuse, suggesting that demonstrating would be appropriate, an action allegedly intended to incite destruction or damage to property.
